By accessing or using the Volta Fusion website (volta-fusion.com) and services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our website or services.

Description of Services

Volta Fusion provides public speaking training, communication coaching, and related professional development services to individuals and organizations. Our services include:

  • Private coaching sessions
  • Group workshops and bootcamps
  • Corporate training programs
  • Online courses and virtual training
  • Educational resources and materials

Eligibility

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms of Use.

Account Registration

Some services may require you to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as necessary
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

Payment and Fees

Pricing

All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. Current pricing is available on our website.

Payment Terms

  • Payment is required at the time of enrollment unless otherwise agreed in writing
  • We accept major credit cards and other payment methods as indicated
  • You authorize us to charge the payment method provided for all fees

Refund Policy

  • Multi-session programs: Full refund if canceled within 7 days of purchase and before the first session
  • Single sessions: No refunds after scheduling confirmation
  • Unused sessions may be transferred to another participant or credited toward future programs within 12 months
  • No refunds for partially completed programs

Scheduling and Cancellations

Client Cancellations

  • Sessions may be rescheduled with 48 hours notice at no charge
  • Sessions canceled with less than 48 hours notice will be forfeited
  • Emergency exceptions may be considered on a case-by-case basis

Our Cancellations

We reserve the right to cancel or reschedule sessions due to instructor illness, emergencies, or other unforeseen circumstances. In such cases, we will offer rescheduling or a pro-rated refund.

Intellectual Property Rights

Our Content

All content on our website and provided through our services, including text, graphics, logos, images, audio, video, software, and course materials, is owned by Volta Fusion or our licensors and is protected by copyright and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our materials solely for your personal, non-commercial use in connection with the services you have purchased.

Restrictions

You may not:

  • Copy, modify, distribute, or create derivative works from our materials
  • Reverse engineer or attempt to extract source code
  • Remove or alter copyright notices or proprietary markings
  • Use our materials for commercial purposes without written permission
  • Share access credentials or materials with unauthorized third parties

User Content and Recordings

Session Recordings

We may record coaching sessions for training and quality assurance purposes. By participating in our services, you consent to such recordings. Recordings are used solely for your benefit and internal purposes unless you provide separate written consent for other uses.

Testimonials and Feedback

If you provide testimonials, reviews, or feedback, you grant us a perpetual, royalty-free license to use, reproduce, and display such content for marketing and promotional purposes.

Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Harass, abuse, or harm other users or instructors
  • Transmit viruses, malware, or harmful code
  • Interfere with the proper functioning of our website or services

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties regarding accuracy, reliability, or completeness of content
  • Warranties that services will be uninterrupted or error-free
  • Warranties regarding specific results or outcomes from our training

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOLTA FUSION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Business interruption
  • Personal injury or emotional distress

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Volta Fusion, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

  3. If mediation fails, binding arbitration in Toronto, Ontario

Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario for any legal proceedings that cannot be resolved through arbitration.

Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms of Use, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Volta Fusion regarding our services.
